Discretion should have been used when granting Outline Application HS/0A/13/00600 whilst this was under transition through an Inspectorate's office process. A condition of this Application made subject to Inspection outcome of the Develop Management Plan so as not to prejudge this. I have complaint with LGO reference 14000398 referring to contravening the s.68 of Town and Country Planning Act. 2000+ objections.

Speckled Wood is a name that has been used for at least five years and is on public landmarks, been used in the press as reference to this nomenclature. I am also aware that discretion should have been used when granting Outline Application HS/0A/13/00600 whilst this area was under transition through process of the Inspectorate's office. I feel a condition of this Application being granted should have been made subject to the outcome of the Inspection of the Develop Management Plan so as not to prejudge this. I have complaint with LGO reference 14000398 in reference to this. My complaint also sheds concerns that information which was made available to this process was not taken into account. In s.68 of Town and Country Planning Act 1990, it clearly states any person who is in noncompliance of certificate making false or mis-leading in material shall be guilty of an offense. The Hastings Borough Councils land ownership maps show an area of this land as unregistered. I am in possession of this land and took the precaution to fence said area. Hastings Borough Council Planners were made aware of this 21st February prior to the Planning Meeting. These documents were ignored.

In Town and Country Planning Act 1990 s.70(2) Determination of Applications It clearly states In dealing with an Application the Authority shall have regard for provisions of the Development Plan. It has not been the case that there is a Planning Condition on the Outline Planning Application passed on this site on the 25 February 2014 in reference to the transition of the DMP. To enable Inspector to make un-biased decision where an Inspector can rule on this site and make a provision for non-development herein. This area is covered with highly invasive plants Japanese knotweed and Giant Hogweed. Japanese Knotweed is known to damage paths, drives, walls and even foundations. There have been 49 years of Planning on this Historic Woodland of which none has come to fruition due to the unsuitability of the land. Lessons have NOT been learned. There is extensive indigenous Species of Flora and fauna on the site some which are protected under the Wildlife and Countryside Act (as amended)1981 and although catalogued online have not been registered with the Sussex Bio Centre due to time restraints

There has been a huge public objection to this site being developed in 2012, 1231 respondents ask for this area not to be built on. In 2013, 464 additional objections came in by way of a Planning Application, every objection which was received stating no to housing in this area. I strongly believe that these objections should be made available to the Inspector during this hearing. In a 2014 Consultation in excess of 1218 responses were obtained requesting this area is removed from the DMP. These responses have resulted in some of the area being reclassified but not all. This ignored the public wishes to save the whole Woodland Ghyll and is not democratic under the Local-ism Act. The Friends of Speckled Wood recently attended Priory Meadow Shopping Centre during the Consultation. Out of 499 people they saw who objected and signed had previously never heard of the Development Management Plan. There has only been one Public Notice and clearly the general Public is not aware of the Development Management Plan.

Changes to site references between consultations are misleading, "Speckled Wood" and Frederick Road sites are ALL within the Upper Ore Valley which lies to the West of the A259. Clive Vale to the East of the A259 is not connected to the Upper Ore Valley.

CV01 hasn't been managed by its owners & has become a more mature wildlife habitat in which resident-led groups maintain footpaths/green areas. This wooded Ghyll is recognised for its rare flora and fauna something which is not recognised under HN8, HN9 and HN10. HN7 should also apply if any part is developed.

It has been brought to our attention that certain aspects of this latest DMP submission are incorrect, however due to the short 6 week consultation period allowed by Hastings Borough Council we are unable to go into as much detail as we would have liked therefore we will only be commenting on the area behind our residence known as "Speckled Wood".

In the March 2012 DMP Consultation Document this area was referred to as Upper Ore Valley and given site references AOl, A30, with the Little Acres site to the West of Frederick Road being A24 also within the Upper Ore Valley, however for some obscure reason that we cannot find it has been changed to Clive Vale and given the following site references CVOl was AOl, CV02 was A24, CV03 was A30, CV04 which was a part of AOl. These site reference changes are very misleading to say the least as "Speckled Wood" and the Frederick Road site are ALL within the Upper Ore Valley which lies to the West of the A259 Old London Road this is also mainly in the local Tressel! ward area.

Clive Vale is a mainly residential area to the East of the A259 Old London Road and is not connected to the Upper Ore Valley, Clive Vale is in the local Ore ward, and the area also has different Councillors representing the residents living within its Ore ward boundary, they do NOT represent the residents in the CV area designated as Clive Vale in the DMP.

The area now designated as CVOl lies directly to the rear of our property which we have lived in since 2000 this site which has also had 11planning permissions granted or extended, from 1966 to date, we have found that this site has been under two different ownerships and is currently owned by an offshore company called Hollyberry Holdings, they have not carried out any site management whatsoever since 2000 and it is quite clear that this neglect has allowed the flora and fauna to flourish, Hollyberry Holdings are only interested in trying to sell this difficult site on to make a large profit, why else would they have not developed it.

Area CVOl has over the past 40 or so years become more of a mature wildlife habitat with the increasing pressure which other developments have put on the habitat areas within the rest of the Ore Valley to the West of Frederick Road, the various resident led groups have recognised this and are continuing to work maintaining footpaths and green areas within "Speckled Wood" for the local community to enjoy. This wooded Ghyll is finally being recognised for its rare flora and fauna something which HBC has failed to recognise under its policies HN8 Biodiversity and Green Space, HN9 Areas of Landscape Value and HN10 Amenity Green Space, HN7 Should also apply if any part is developed.
